DUI means “Driving Under The Influence” and can have severe consequences in Florida, as in most states. The Blood Alcohol Level (BAL) limit is 0.08%.

In case an officer stops you under the suspicion of DUI and you refuse submitting to a test, then your license is suspended for 12 months and in the case of subsequent refusals, for 18 months. Moreover, the officer can make use of (reasonable) force, in order to take blood without your consent.

Driving under DUI can result in paying significant fines, serving times in prison, having to use an interlock, etc. The severity of such consequences depends on weather this is the first, second, third or fourth offense.

Florida DUI: First Offense

  • Fine of $500 to $1,000 for BAL between 0.08% and 0.15% and fine of $1,000 to $2,000 for BAL above 0.15%
  • Imprisonment of 6 months for BAL between 0.08% and 0.15% and 9 months imprisonment for BAL above 0.15%. To note, treatment may be sought instead of prison.
  • License suspension of 180 days to 1 year
  • Interlock required for 6 months
  • Community service of 50 hours, $10 for each hour served
  • Vehicle impound: 10 days
  • Hardship reinstatement after DUI school successfully completed

Florida DUI: Second Offense

  • Fine of $1,000 to $2,000 for BAL between 0.08% and 0.15% and fine of $2,000 to $4,000 for BAL above 0.15%
  • Imprisonment of 9 months for BAL between 0.08% and 0.15% and 12 months imprisonment for BAL above 0.15%. There are 10 days of mandatory imprisonment if the offence is within 5 years of previous offense.
  • License suspension of 5 years if offence is within 5 years of the previous offense
  • Interlock required for 1 year if BAL between 0.08% and 0.15% and for 2 years for BAL above 0.15%
  • Vehicle impound: 30 days if offence is within 5 years of previous offense
  • Hardship reinstatement after 1 year and if DUI school successfully completed

Florida DUI: Third Offense

  • Third degree felony if offence is within 10 years of previous offense
  • Fine of $2,000 to $5,000 for BAL between 0.08% and 0.15% and fine of +$4,000 for BAL above 0.15% if minor is present
  • Imprisonment of 12 months. There are 30 days of mandatory imprisonment if the offence is within 10 years of previous offense.
  • License suspension of 10 years if offence is within 10 years of the previous offense
  • Interlock required for 2 years
  • Vehicle impound: 90 days if offence is within 10 years of previous offense
  • Hardship reinstatement after 2 year and if DUI school successfully completed

Florida DUI: Fourth Offense

  • Imprisonment of up to 5 years
  • Fine of +$2,000
  • Permanent license suspension
